At Marketing by Jim, accessible from marketingbyjim.com, one of our main priorities is the privacy of our visitors. This Privacy Policy document contains types of information that is collected and recorded by Marketing by Jim and how we use it.

Marketing by Jim’s basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Information we collect and the specific context in which we collect the information:

Anti-bot assessments
We use CAPTCHA and related services across our website to mitigate brute force logins and as a means of spam protection. We have a legitimate interest in protecting our website and the broader Internet community from credential stuffing attacks and spam. When you log into your accounts and fill specific forms in, the CAPTCHA (or similar) service evaluates various information (e.g. IP address, how long the visitor has been on the app, mouse movements) to check whether the data is possibly filled out by an automated program instead of a human. Log files generated with website interactions
Marketing by Jim follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this and a part of hosting services’ analytics. The information collected by log files include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the site, tracking users’ movement on the website, and gathering demographic information.

Cookies and web beacons
Like any other website, Marketing by Jim uses ‘cookies’. These cookies are used to store information including visitors’ preferences, and the pages on the website that the visitor accessed or visited. The information is used to optimize the users’ experience by customizing our web page content based on visitors’ browser type and/or other information.

Voluntary correspondence
When you write Marketing by Jim with a question or to ask for help, we keep that correspondence, including the email address, so that we have a history of past correspondences to reference if you reach out in the future.

We also store any information you volunteer like surveys. Sometimes when we do customer interviews, we may ask for your permission to record the conversation for future reference or use. We only do so if you give your express consent.

Information we do not collect
We don’t collect any characteristics of protected classifications including age, race, gender, religion, sexual orientation, gender identity, gender expression, or physical and mental abilities or disabilities. You may provide these data voluntarily, such as if you include a pronoun preference in your email signature when writing into our Support team. Note, while we do not collect the information detailed above, it is possible that our advertising or analytics partners may have access to that information (perhaps provided by you or inferred by your online activity) and may share anonymized and aggregated statistics with us, in accordance to their privacy policies.

We also do not collect any biometric data. You may be given the option to add a picture to your user profile, which could be a real picture of you or a picture of something else that represents you best. We do not extract any information from profile pictures: they are for your use alone.

When we access or share your information
Our default practice is to not access your information. The only times we’ll ever access or share your info are:

  • To provide products or services you’ve requested.
  • To help you troubleshoot or squash a software bug, with your permission. If at any point we need to access your account to help you with a Support case, we will ask for your consent before proceeding.
  • When required under applicable law.

Third-party ad servers and analytics services uses technologies like cookies, JavaScript, or Web Beacons that are used in their respective advertisements or analytics tools, which may appear on Marketing by Jim, which are sent directly to users’ browser. They automatically receive your IP address when this occurs. These technologies are used to measure website traffic and/or the effectiveness of their advertising campaigns and/or to personalize the advertising content that you see on websites that you visit.

Note that Marketing by Jim has no access to or control over the cookies that are used by third-party advertisers or analytics providers. These providers may share certain anonymous information they have collected about you with Marketing by Jim.

Children’s information
Another part of our priority is adding protection for children while using the internet. We encourage parents and guardians to observe, participate in, and/or monitor and guide their online activity.

Marketing by Jim does not knowingly collect any Personal Identifiable Information from children under the age of 13. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will do our best efforts to promptly remove such information from our records.

Our Privacy Policy applies only to our online activities and is valid for visitors to our website with regards to the information that they shared and/or collect in Marketing by Jim. This policy is not applicable to any information collected offline or via channels other than this website.

Your rights with respect to your information
At Marketing by Jim, we apply the same data rights to all customers, regardless of their location. All data is encrypted via SSL/TLS when transmitted from our servers to your browser. The database backups are also encrypted.

Our products and other web properties are operated in the United States. If you are located in the European Union or elsewhere outside of the United States, please be aware that any information you provide to us will be transferred to and stored in the United States.
